As set out in the Police Act and Police Conduct and Oversight Regulation, the Edmonton Police Commission (Commission) is responsible for receiving, evaluating and addressing Level 4 complaints against the Chief of Police (Chief) of the Edmonton Police Service (Service).
The Commission is committed to providing oversight to the Chief and will endeavor to address Level 4 Complaints against the Chief in a fair and timely manner.
Definitions:
Level 4 Complaint: The Police Act, RSA 2000, c P-17 (Act) defines a Level 4 Complaint as a complaint that alleges unsatisfactory performance but does not meet the threshold of a Level 1, Level 2, or Level 3 complaint.
The Alberta Police Review Commission describes a Level 4 complaint as complaints related to police officers’ professional performance, such as failure to follow procedures or meet job expectations.
Guidelines:
1) As per the Police Conduct and Oversight Regulation (Alberta Regulation 263/2025), Level 4 complaints about the conduct of the Chief will be referred directly to the Commission for disposition.
2) The Commission will acknowledge receipt of the complaint to both the Police Review Commission, if received through that office, and the complainant. The Commission may contact the complainant for further information if required. The Commission is not required to contact the complainant regarding the disposition of the complaint.
3) The Commission may dispose of a Level 4 complaint against the Chief as it sees fit to do so after review by the Commission.
4) Additional external legal or other advice, review, or reporting may be sought at any time throughout the evaluation process by the Commission.
Procedures:
1) The Commission’s legal counsel will intake all Level 4 complaints against the Chief and shall notify the Commission’s Chair and Vice Chair of the complaint.
2) The Chief may be asked to provide an optional response to the complaint. If so, the Chief will be provided with a copy of the complaint and given a reasonable period of time to respond.
3) The Commission’s legal counsel will make a preliminary assessment which will be presented to the Commission’s Human Resources Committee (HRC).
4) The HRC will review the complaint, assess, and make a recommendation(s) to the Commission for decision regarding disposition of the complaint.
